1. Acceptance of Terms

By downloading, installing, or using PocketNoise ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you ("User") and Daibou007 Team ("we", "us", or "our").

2. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple device you own or control, solely for your personal, non-commercial purposes, in accordance with these Terms and Apple's App Store Terms of Service.

3. Permitted and Prohibited Use

You agree to use the App only for lawful purposes. You must not:

• Reverse engineer, decompile, or disassemble the App
• Modify, copy, or create derivative works based on the App
• Remove or alter any proprietary notices or labels on the App
• Use the App in any way that violates applicable local, national, or international laws or regulations
• Attempt to gain unauthorized access to any systems connected to the App

4. No Account Required

PocketNoise does not require you to create a user account. All features are available immediately after installation. All data you generate (noise recordings, decibel samples, app preferences) is stored locally on your device.

5. One-Time Purchase

PocketNoise is a paid app available for a one-time purchase on the Apple App Store. There are no subscription fees, in-app purchases, or recurring charges. All features are available immediately upon purchase.

6. Microphone Usage

The App requires access to your device microphone to measure ambient sound levels. By using this feature, you acknowledge that:

• Microphone input is processed in real time on your device solely to calculate decibel (dB) values.
• No audio is recorded, stored as an audio file, or transmitted to any server.
• Only numerical dB measurements are saved locally as part of your noise log.
• You may revoke microphone permission at any time via iOS Settings. Core measurement features will not function without this permission.

7. Location Usage

The App may request access to your device location for an optional GPS tagging feature. By using this feature, you acknowledge that:

• Location access is entirely optional. The App's core features work without it.
• Location data is only accessed when you explicitly tag a noise recording.
• GPS coordinates are stored locally on your device as part of the noise record.
• No location data is transmitted to any external server.
• You may revoke location permission at any time via iOS Settings.

8. Measurement Accuracy Disclaimer

PocketNoise uses your iPhone's built-in microphone to estimate sound pressure levels. By using the App, you acknowledge that:

• Readings are provided for general reference and informational purposes only.
• Results may vary by ±3–5 dB compared to calibrated professional sound level meters.
• The App is not a substitute for certified Type 1 or Type 2 sound level meters required for OSHA compliance, legal proceedings, or regulatory noise assessments per IEC 61672.
• We are not liable for decisions made based on in-app dB readings.

9. Notifications

PocketNoise may send local notifications for Sleep Guard alerts when noise exceeds your configured threshold during quiet hours. These notifications are generated on-device using the iOS notification system. You may disable notifications at any time in iOS Settings → Notifications → PocketNoise.

10. Intellectual Property

All content, design, code, graphics, and functionality of the App are the exclusive property of Daibou007 Team and are protected by copyright, trademark, and other applicable intellectual property laws.

You may not copy, distribute, publicly display, or create derivative works from any part of the App without our express written permission.

11. User Data

You retain ownership of all noise recordings and data you create using the App. All data is stored locally on your device. We have no access to your data at any time. Uninstalling the App permanently deletes all locally stored data.

12. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the App will be uninterrupted or error-free. Measurement accuracy may vary depending on device model, microphone quality, and environmental conditions.

13. Limitation of Liability

To the fullest extent permitted by applicable law, Daibou007 Team shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including but not limited to damages resulting from reliance on dB readings for safety or legal decisions.

14. Termination

These Terms are effective until terminated. Your rights under these Terms will terminate automatically if you fail to comply with any of its provisions. Upon termination, you must cease all use of the App and delete all copies from your devices.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised "Last Updated" date. Your continued use of the App following any changes constitutes your acceptance of the revised Terms.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of California, USA, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in California, USA.
